Terms of Service

Please read these Terms carefully before using our Platform.

1. Introduction and Acceptance

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“You” or “User”) and Grizzly Travel AI, a sole proprietorship registered in the Province of British Columbia, Canada (“Grizzly Travel AI,” “we,” “us,” or “our”), governing your access to and use of the Grizzly Travel AI website, mobile applications, AI-powered tools, and all related services (collectively, the “Platform”).

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, Cookie Policy, and AI Terms of Use, each of which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction of residence (whichever is greater), and possess the legal capacity to enter into a binding agreement to use this Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements. If you are using the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Scope of Services

3.1 Travel Services

Grizzly Travel AI provides an AI-powered online travel agency platform that enables Users to search, compare, and book travel-related services, including flights, hotel and accommodation reservations, car rentals, airport and destination transfers, and tours, excursions, and other activities (collectively, “Travel Services”).

3.2 Role as Intermediary

Grizzly Travel AI acts solely as an intermediary between you and third-party travel service providers (“Travel Suppliers”). We do not own, operate, manage, or control any of the Travel Services listed on our Platform. When you make a booking through Grizzly Travel AI, your contractual relationship for the delivery of the Travel Service is directly with the applicable Travel Supplier, subject to that Travel Supplier’s own terms, conditions, rules, and restrictions.

Grizzly Travel AI does not guarantee the quality, safety, suitability, or availability of any Travel Service. We are not responsible for any acts, errors, omissions, representations, warranties, or negligence on the part of any Travel Supplier, nor for any personal injury, death, property damage, or other loss resulting from the use of any Travel Service.

4. Account Registration and Security

Certain features of the Platform may require you to create a user account. When creating an account, you agree to provide accurate, current, and complete registration information, maintain and promptly update your account information, keep your login credentials confidential and secure, accept responsibility for all activities that occur under your account, and notify us immediately at [support@grizzlytravel.ai] if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate any account that we reasonably believe has been compromised, is being used fraudulently, or is in violation of these Terms.

5. Bookings and Reservations

5.1 Booking Process

A booking is initiated when you select a Travel Service and proceed through the checkout process on the Platform. By completing a booking, you confirm that all information provided is accurate and complete, you are authorized to make the booking on behalf of all travelers named in the reservation, you have reviewed and accept the applicable Travel Supplier’s terms, conditions, rules, and restrictions, and you authorize the applicable charges to your selected payment method.

5.2 Booking Confirmation

A booking is confirmed only upon your receipt of a confirmation email from Grizzly Travel AI containing a booking reference number, itinerary details, pricing breakdown including applicable taxes and fees, and the applicable cancellation and modification policy. Until such confirmation is received, no binding reservation exists.

5.3 Travel Documents and Requirements

It is your sole responsibility to ensure that all travelers possess valid passports, visas, and other travel documents required for the journey, you have reviewed and comply with all entry, exit, health, and customs requirements for your destination(s), you have obtained any required vaccinations or health certificates, and you arrive at departure points and check-in locations at the required times. Grizzly Travel AI shall not be liable for any costs, losses, or damages arising from your failure to comply with travel document or entry requirements.

5.4 Special Requests

Special requests (including but not limited to dietary requirements, room preferences, accessibility needs, bed configurations, and early check-in or late check-out) are forwarded to the relevant Travel Supplier on a best-efforts basis but are not guaranteed. We recommend contacting the Travel Supplier directly to confirm the availability of any special arrangements.

5.5 Group Bookings

For bookings of ten (10) or more travelers, special terms and pricing may apply. Please contact our customer support team at [support@grizzlytravel.ai] for group booking assistance.

6. Cancellations, Modifications, and Refunds

6.1 Cancellation Policies

Cancellation terms vary by Travel Supplier and product type. The specific cancellation policy applicable to your booking is displayed during the booking process and included in your confirmation email. It is your responsibility to review and understand the applicable cancellation terms before completing your booking.

Cancellation policies generally fall into one of the following categories:

Free Cancellation: The booking may be cancelled without penalty within the specified timeframe. Refunds are processed to the original payment method.

Partial Refund: A cancellation fee applies, with the balance refunded to the original payment method.

Non-Refundable: The booking is non-refundable and cannot be cancelled for a refund. Non-refundable bookings are clearly marked at the time of purchase.

6.2 Grizzly Travel AI Service Fees

Grizzly Travel AI may charge a service fee in connection with bookings processed through the Platform. Where applicable, any Grizzly Travel AI service fees and their refundability will be clearly disclosed during the booking process. The specific terms regarding the refundability of service fees will be set forth in the booking confirmation.

6.3 How to Cancel or Modify

You may cancel or modify eligible bookings through your account on the Platform, by contacting our customer support team at [support@grizzlytravel.ai], or through our AI chatbot. We recommend managing cancellations through the Platform for the fastest processing.

6.4 Refund Processing

Approved refunds are processed to the original payment method within five (5) to ten (10) business days. Actual receipt of the refund may take additional time depending on your financial institution. Grizzly Travel AI is not responsible for processing delays caused by banks or third-party payment providers.

6.5 No-Show Policy

Failure to check in or arrive for a booked Travel Service without prior cancellation constitutes a “no-show.” No-shows are generally non-refundable, and any remaining portions of the booking (such as subsequent hotel nights) may be forfeited at the Travel Supplier’s sole discretion.

6.6 Supplier-Initiated Cancellations

In the event a Travel Supplier cancels your booking, Grizzly Travel AI will notify you as soon as reasonably practicable and will make commercially reasonable efforts to assist you in securing a comparable alternative or obtaining a full refund from the Travel Supplier.

6.7 Force Majeure

Neither Grizzly Travel AI nor any Travel Supplier shall be liable for failure to perform obligations under a booking where such failure results from events beyond reasonable control, including but not limited to natural disasters, pandemics or epidemics, acts of government or regulatory authorities, armed conflict or terrorism, strikes or labor disputes, or severe weather events. In such circumstances, we will work with Travel Suppliers to facilitate rebooking or refunds where possible, but cannot guarantee full reimbursement.

7. Pricing and Payment

7.1 Pricing

Prices displayed on the Platform are in the currency selected by you and include applicable taxes and fees unless otherwise clearly stated. Prices are subject to change based on availability, demand, currency fluctuations, and other factors. The final price is confirmed at the time of checkout and reflected in your booking confirmation.

7.2 Accepted Payment Methods

We accept major credit and debit cards (Visa, Mastercard, American Express, Discover), select digital wallets, and other payment methods as displayed at checkout. Availability of payment methods may vary by region and booking type.

7.3 Payment Authorization

Upon initiating a booking, we or the Travel Supplier may place a temporary hold (pre-authorization) on your payment method to verify the availability of funds. This hold is released automatically if the booking is not completed. Certain Travel Suppliers may also place additional pre-authorization holds in connection with your reservation.

7.4 Currency Conversion

If the currency of your payment method differs from the currency of the booking, your financial institution may apply a currency conversion fee. Grizzly Travel AI is not responsible for exchange rate fluctuations or fees imposed by your bank or card issuer.

7.5 Fraud Prevention

We employ industry-standard fraud detection and prevention measures. We reserve the right to request additional verification for suspicious transactions and to cancel any bookings associated with fraudulent activity, abuse, or violation of these Terms.

8. Travel Insurance

Grizzly Travel AI strongly recommends that all Users purchase comprehensive travel insurance for their bookings. Travel insurance may provide coverage for trip cancellations, medical emergencies, lost or delayed luggage, travel delays, and other unforeseen events.

Grizzly Travel AI may offer travel insurance products through third-party insurance providers. Any such insurance products are subject to the insurer’s own terms, conditions, exclusions, and limitations. Grizzly Travel AI is not an insurance provider and does not underwrite or guarantee any insurance product.

9. User Content and Reviews

9.1 Eligibility to Submit Reviews

Only Users who have completed a booking through the Platform are eligible to submit a review for the relevant Travel Service. Reviews must be based on genuine, firsthand personal experience.

9.2 Content Standards

All User-submitted content must comply with the following standards. Content must not contain defamatory, threatening, abusive, discriminatory, obscene, or otherwise objectionable material, personal information of third parties without their consent, spam, commercial solicitations, or promotional material unrelated to the Travel Service, or content that infringes upon the intellectual property rights of any third party.

9.3 License Grant

By submitting content to the Platform, you grant Grizzly Travel AI a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from such content in connection with the operation and promotion of the Platform.

9.4 Moderation and Removal

Grizzly Travel AI reserves the right to review, moderate, edit, or remove any User-submitted content at its sole discretion, including content that violates these standards or that we deem inappropriate. We may employ automated tools and/or human moderators for content review.

10. Intellectual Property

10.1 Ownership

All content, design elements, software, algorithms, trademarks, trade names, logos, graphics, and other intellectual property displayed on or accessible through the Platform are owned by or licensed to Grizzly Travel AI and are protected by applicable Canadian and international intellectual property laws. No right, title, or interest in any Platform content is transferred to you by virtue of your use of the Platform.

10.2 Limited License

Subject to your compliance with these Terms, Grizzly Travel AI grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any Platform content without our prior written consent.

10.3 Copyright Infringement

If you believe that content on the Platform infringes your copyright, please submit a written notice to [legal@grizzlytravel.ai] containing identification of the copyrighted work claimed to be infringed, identification of the allegedly infringing material and its location on the Platform, your contact information (name, address, telephone number, and email address), a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law, and a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

11. Prohibited Conduct

You agree not to use the Platform to make fraudulent, speculative, or false reservations, impersonate any person or entity or misrepresent your affiliation, interfere with or disrupt the Platform, its servers, or connected networks, use automated means (including bots, scrapers, or crawlers) to access or collect data from the Platform, attempt to circumvent any security or authentication measures, transmit viruses, malware, or other harmful code, or violate any applicable local, provincial, national, or international law or regulation.

Grizzly Travel AI reserves the right to investigate and take appropriate action against any User who violates these prohibitions, including suspending or terminating access, cancelling bookings, and reporting violations to law enforcement.

12. Dispute Resolution

12.1 Informal Resolution

If you have a complaint or dispute regarding a booking or our services, you agree to first contact our customer support team at [support@grizzlytravel.ai] to seek an informal resolution. We will make commercially reasonable efforts to resolve your concern within thirty (30) days.

12.2 Binding Arbitration

If a dispute cannot be resolved informally within thirty (30) days, you and Grizzly Travel AI agree that the dispute shall be resolved by final and binding arbitration, rather than in court. Arbitration shall be administered in accordance with the rules of the British Columbia International Commercial Arbitration Centre (BCICAC), or such other recognized arbitral institution as may be mutually agreed upon. The seat of arbitration shall be Vancouver, British Columbia, Canada. The language of arbitration shall be English. The arbitrator’s award shall be final, binding, and enforceable in any court of competent jurisdiction.

12.3 Class Action Waiver

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND GRIZZLY TRAVEL AI AGREE THAT ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU HEREBY WAIVE THE RIGHT TO PARTICIPATE IN, COMMENCE, OR BE A MEMBER OF ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST GRIZZLY TRAVEL AI. THIS CLASS ACTION WAIVER IS AN ESSENTIAL PART OF THIS ARBITRATION AGREEMENT AND CANNOT BE SEVERED FROM IT.

Notwithstanding the foregoing, this class action waiver shall not apply in any jurisdiction where such waiver is prohibited by mandatory applicable law. In such jurisdictions, the enforceability of this waiver shall be determined by the applicable court or tribunal.

12.4 Exceptions to Arbitration

Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidentiality obligations.

12.5 Chargebacks

We encourage you to contact our customer support team before initiating a chargeback with your financial institution. Filing a chargeback without first attempting to resolve the matter through our dispute resolution process may result in the suspension or termination of your account. We maintain comprehensive transaction records and will respond to all chargeback inquiries.

13. Limitation of Liability

13.1 Disclaimer of Warranties

THE PLATFORM AND ALL TRAVEL SERVICES ACCESSIBLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OR REPRESENTATIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GRIZZLY TRAVEL AI, ITS OWNER, AFFILIATES, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR ANY TRAVEL SERVICES BOOKED THROUGH IT, REGARDLESS OF THE THEORY OF LIABILITY.

13.3 Cap on Liability

IN NO EVENT SHALL GRIZZLY TRAVEL AI’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED THE TOTAL AMOUNT OF SERVICE FEES ACTUALLY PAID BY YOU TO GRIZZLY TRAVEL AI IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13.4 Travel Supplier Liability

Grizzly Travel AI is not liable for the acts, omissions, defaults, misrepresentations, or negligence of any Travel Supplier, including but not limited to flight delays, cancellations, or overbookings, accommodation quality, cleanliness, or misrepresentation, vehicle condition or rental disputes, personal injury, illness, death, or property damage occurring during or in connection with any Travel Service, and failure by the Travel Supplier to deliver the Travel Service as described.

13.5 Jurisdictional Limitations

Certain jurisdictions do not permit the exclusion of implied warranties or the limitation or exclusion of liability for certain categories of damages. If you reside in such a jurisdiction, some or all of the above limitations and exclusions may not apply to you, and you may have additional rights under applicable law. In such cases, Grizzly Travel AI’s liability shall be limited to the fullest extent permitted by the laws of your jurisdiction of residence.

14. Indemnification

You agree to indemnify, defend, and hold harmless Grizzly Travel AI, its owner, contractors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Platform, your violation of these Terms, your violation of any applicable law or the rights of any third party, any booking you make through the Platform, and any content you submit to the Platform.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to the arbitration agreement in Section 12, you consent to the exclusive jurisdiction of the courts located in Vancouver, British Columbia, for any proceedings not subject to arbitration.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, AI Terms of Use, and any other policies referenced herein, constitute the entire agreement between you and Grizzly Travel AI with respect to the Platform and supersede all prior agreements and understandings.

16.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

16.3 Waiver

No failure or delay by Grizzly Travel AI in exercising any right under these Terms shall constitute a waiver of that right.

16.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Grizzly Travel AI may assign its rights and obligations without restriction.

16.5 Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via notice on the Platform or by email. Your continued use of the Platform following the posting of changes constitutes acceptance of the revised Terms.
